Suing Process Against CA in Missouri?

Ok. Here we go. I want to get the ball rolling on this ASAP.

State of Debt: Missouri

Collection Agecy: TRS Recovery Services, Inc.

C & D and Debt Verification Letters sent on Jan. 22nd 2008 by USPS with Confirmation Receipt. Letters received by CA on Jan. 25th 2008.

The clock begins...

Jan. 27th 2008, 'Unknown' shows on my caller ID. I answer and no response.

Jan. 28th 2008, CA representative calls in reference to 'debt owed'. Questions whether I have funds available to pay debt. I let her know that their company has received the aforementioned letters and that she needs to stop calling. She states she was unaware of that and asks question regarding funds available once more. I ask for her name (for record purposes) and say thank you and hang up.

Jan. 31st 2008, at 8:33AM. CA rep. calls and gives usual BS about 'debt owed and will you be able to pay it, yada yada yada'. I told her that I have confirmation that her company received my letters and that she nor anybody else from her company call me again regarding it and they have to verify my debt. She tells me her company receiving those letters doesn't have anything in the system about the letters. I reiterated the fact that I had confirmation 'in my hand' that her company had received them and that also her in regards to these letters not being her her system that it was irrelevent at this point. The only system that needs to have this information is the USPS.

So far I count 3 violoations. calling after receiving C&D, not verifying debt and still calling, and calling before 9AM.

The above is basically bringing you up-to-speed on the current situation. With that, I am hoping that somebody could help me in the actual process of taking them to Small Claims Court and taking their money for not only ignoring my rights OUR rights, but to prove a point...that there are people out there like me and they better believe we're not going to just bow down to them.

It will probably hold up, but honestly nothing holds up on any proof like a John Hancock on a piece of paper. I would add the green return receipt card to all future correspondance. Even if it's not proper documentation, if you want to sue then sue. These companies sue all the time without proper documentation. They win about 99% of the time because no one shows up or demands their proof of the debt.

When the rep called she probably didn't even look to see if they had anything in their file.
