long road ahead Posted January 28, 2008 Report Share Posted January 28, 2008 What a mess. I had a providian account that was charged off in September, 2002. Unifund bought the account and started aggressively calling me in 2006. I made the mistake of agreeing to a $50 payment and just learned that put in motion another 7 years for me. Lately, they have been calling and leaving countless messages. Additionally, they are listed on all three of my reports as "accounts" not collections. Further, they are reporting me late every month, which is very aggravating. My question is, can they do this and is it too late to send a DV letter given the fact that I made a payment in 2006? The debt amount is $644.00.No, you did not bring account current, so the original DOFD is the only date that applies. Ignore the other dates. SOL in Washington is 3 for "Open" and 6 for "written". Not sure how Washington treats CC's? If 6 years then you are not run on the SOL, but if 3 clearly the SOL has run. Find out quickly which one applies. Search for Amerikaner83 on this site as the Washington State expert. If it's run, these guys can't touch you. Don't ignore any collection attempts, but don't talk to them on the phone. You did reset the SOL by paying..and the SOL is typically 6 years. WA law does not specifically state any special SOl for "open" type accounts, just "verbal" and those "not arising from writing or a written instrument".....I've had several lawyers tell me 6 yrs is what most judges go by. But it's not all bad news: Check out my signature links for some cool stuff CAs have to abide by if they want to be able to take money form WA residents.But regarding your specific situation - sure you can DV them...but they are not obligated to answer. I would do a FCRA Section 523 investigation with them, IIWY.
