Now correct me if I am wrong.Ok say you have a collection on your credit report from a collection company in california, the time they have to sue you is based on where you stay and or where the collection company is located? isislc Posted March 16, 2008 Report Share Posted March 16, 2008 Actually, if you use SOL for a defense, you're bound by the SOL in the state you now live in. For ex. if you lived in Wisconsin which has an SOL of 6 years, you break a contract there etc. now you move to Ohio. Now that you live in Ohio, the CA for the contract you broke is coming after you, you're now stuck with an SOL of 15 yrs. The only way that wouldn't apply is if you're tolling. Once you leave the state, the SOL temporarily is suspended, if you come back it starts up again. So if you purposely leave the state till you're out of SOL and then come back thinking you're safe, no you aren't. You just restarted the SOL for that state.
