how to dispute late fees

My OC charged me a late fee even though, as confirmed by the account statement, I had paid the minimum before the due date.

I wrote to them about this, and they replied their records show the fee was properly charged, so they refused to issue a credit.

Does the FCBA consider this "billing error"? What should I do next?

Did you call and talk to a rep?

Writing a letter for something like this is overkill.

If you have proof that you paid it call talk to a supervisor (Be Very Nice) inform them that there was a mistake in your billing and that you would like to get it corrected.

Tell them that you have the payment confirmation and don't know why you were charged a late fee.

As long as you have not been late several times, chances are they will credit you and remove the late's from your CR.

I called and they begrudgingly agreed to remove the late fee they had applied even though their statement shows I had paid the minimum before the due date.

The rep claimed the terms of the cardmember agreement "that I'm looking at on my screen say we can still charge a late fee."

When I pointed out that was different than the written agreement I had in my hand, I asked him to read to me what he had. His story changed and he said to wait while he pulled up the agreement on his screen. He then hung up.
