cupcake72
Hello CIC family,I'm so glad (oddly enough) to be here and have read so much on this site that I feel as though I already know many of you. To get quickly to the point, as I was told to do in a "Newbie" post-it, I've read all of your knowledgable advice and now feel confident enough to begin my credit repair program...with your help of course.I've just completed my very 1st DV letter and would love it if you would give me some constructive criticism. I've recently obtained my CR's from the big 3 CRA's and all of the TL's seem correct. From what I've read, even if you know that the debt is valid once it's in the hands of a CA the best approach is a DV letter before the 30 day limit is up...so here goes.My NameHilco Receivables, Llc(JDB that allegedly bought my debt from OC -WAMU)DateRe: Hilco Acct #****To Whom It May Concern:I am writing in response to a notice sent to me dated March 10th, 2008 a copy of which is attached. This letter serves as my right to request validation due to my dispute of this debt under the Federal FDCPA laws (Act, 15 USC 1692g Sec. 809 . To be clear, I am respectfully requesting the VALIDATION of this alleged debt.I ask that you provide me with the following: *Evidence of your ownership or assignment of this alleged debt from the original creditor (Name & Address of the original creditor must be supplied). *Account statements from the original creditor documenting the history and exact amount allegedly owed. *Proof of your authorization to do business and operate in this city and state along with valid license number and registered agent. *Copy of the alleged contract / loan agreement between myself and the original creditor bearing my signature. In accordance with the above named Title and Section you must immediately cease and desist all collection attempts of this debt until I am furnished with all of the validation documents listed above. In addition, if your offices fail to respond to this validation request within 30 days after receiving this notice all claims pertaining to this account will be deemed inaccurate or invalidated and must be permanently removed from all sources which you have reported it to. This removal includes any information given to the 3 major credit bureau's (Trans Union, Equifax and Experian). This is a request for information only and not a refusal to pay any validated debt.Thank you,My NameI wanted the letter to sound conversational and not like a form letter. Also, should I include anything? Particularly something regarding them not editing or adding any additional negative information to my CR. I have seen that added in some sample letters. Is it necessary? Thanks for all of your help in advance.
LoveToGod
I wanted the letter to sound conversational and not like a form letter. Also, should I include anything? Particularly something regarding them not editing or adding any additional negative information to my CR. I have seen that added in some sample letters. Is it necessary? Thanks for all of your help in advance. That is probably a good idea, because CRAs & CAs are probably seeing more and more form letters, and they are probably starting to recognize them and may even know where they come from, ie. this board. Is this CA already on all 3 credit reports? Once a CA is on there that is usually it unless it gets sold to another CA.
cupcake72
Thanks for your quick reply Joseph1. This CA, Hilco Rcvbls. LLC, is currently only on my Equifax CR. They also have an inquiry entry on my Trans Union CR but thats it.One more question for everyone is...Should I send the dispute letter to Equifax at the same time that I send the DV letter to the CA or should I wait until approximately 30 days after receiving my green confirmation card back from the CA before sending the dispute letter. Thanks again.
