Can a collection account be marked 120 days late?

Arrow just marked my account 120 days late yesterday on my Equifax credit report! And it made my fico drop!

It is bad enough Arrow did not validate the on time DVL. Now this junk. :evil:

Arrow works as both a third-party collector and a JDB. Do they own the account or are they merely collecting on it? Do they have an agreement with you to collect a certain amount per month or do they not?

To answer your question, if they have an agreement with you to collect per month and you don't comply, then yes they can mark it 120 days past due if indeed it is. If they don't then they cannot. Reporting this way is misleading and a misrepresentation of the status of the account. It is designed to lower your scores.

They sent me a letter stating I owed them in Jan. 2008. I sent them a timely DVL, and they ignored it.

I filed a complaint with the BBB. Arrow sent me a letter a few days ago; stating they got my complaint with the BBB, and they are going to send me validation from the original creditor when they get it from the original creditor.Meanwhile they said they will cease all collection activity until the debt is validated. This letter is dated March 24,2008

4-1-08 they marked my equifax report 120 days late.:evil:

You now have documentation of continued collection activity and can sue under the FDCPA if you have the credit reports you day document the 120 days late after validation request. What do you want to happen? Do you want them gone off your credit report? What do you want to happen next? Are you up to suing them pro se?

Thank you Hannah for your time helping me.

My main goal is to get this off my credit reports.

I guess I would sue if I have to. Should I ?

Or should I take this to the FTC and the AG then sue?

Certainly your AG could help but what kind of account are we talking about here? Utility? Credit? What? Depending on what type, you may have other avenues to dispute it.

This is happening to me exactly, on TU and EX Arrow shows as a collection account. But on EQ it shows as an open account and that it is 120 days late.

Arrow are a rough group! I have DV'd them, I did a complaint with the BBB, AG in IL and OH. Sent out the AG complaints today. We will see what happens from here.

will do, I have managed to get all but 4 baddies off EQ and EX, and I am down to 2 on TU (arrow and first premier) Not sure if FP keeps good records or not I guess i am gonna find out lol. If I can take care of this FP it would kill 2 birds with one stone get arrow off and FP, I have my fingers crossed!

I used that same information, but i really did not like the letter they link to in there I used some information in the letter they have but i took out allot of stuff and made it a little simpler. I sure hope it works. I disputed with the CRA's first and they all validated

This is very helpful. I have an old Cingulay wireless acount (over 6 years old) that honestly, I do owe, but have been waiting for it to drop off. It is reporting as 120 days late. I have been afraid to dispute for fear of them updating it.

That's the double edged sword of credit repair. I disputed an old account like that hoping for a deletion and when they updated the TL, My FAKO dropped 89 points. My FICO however, went up 35. You might see a initial score drop but based on the age of the account it should come back up quickly. Plus, since AT&T bought SBC, you might get lucky.

From reading this thread it looks like I am going to have quite a battle with Arrow. They are not on my credit yet, but I just got a dunning letter from them, and I just sent in a DV. I have the true credit monitoring service. If I see Arrow show up on there before they DV I will file complaints with the FTC, BBB, and AG.

My credit is really starting to look a whole lot better, but I guess Arrow is going to kill it at least for a while.

Are they only reporting on equifax?

To try to answer your question. Does it show up as a collection item or as a Trade Line?

It is worse if shows up as a trade line for the credit score, but for getting credit cards, collections are worse.

For example an I1 or R1 is an account that is currently in good standing, but an I5 or I9 is a very negative acct.

Collections only go up to I5, but a TL can be I9.

The only way you will see this notation is if you live in a state that uses csc instead of equifax. They will sometimes send you a credit report with this notation, or you can go apply for a car at a car dealership and ask them to let you peek at your credit repor, but then you will have an inquiry.

they are reporting on the big 3 for me but only EQ as 120 days late. TU and EX they show up on the very bottom as collection account seriously past due... I did loge a complaint with the BBB in IL, and the AG, in IL and OH.

Check with others, but if it is listed as a collection and not a TL, then I don't think they can do that, and would have good grounds for a lawsuit, especially if they reported before then DVd.

Folks, I must admit I'm not 100% sure of this...but..."120 days late" is just a "status", not an event. It basically means "as of this date when we're reporting, the debtor is at least 120 days late". If it had that status when the CA was assigned to collect it, or when the JDB bought it...it still has a status of "120 days late". If your contract with the OC said they could pass on "status" to CAs or JDBs, then you really haven't got much to go on...

they didn't validate with timely DV - if you do FCRA Section 623 investigation they have to get back to you within 30 days proving the accuracy of their reporting on your CRs...

I got rid of Arrow this way (plus BBB complaint) on an un-timely DV....YMMV.
