shadokeeper
I just placed a call to HSBC about an alleged account that is on my CR form 2005, I called the 1800 number and was transfered to another department, spoke to some one with a very heavy accent! He put me on hold and came back and said that there system was down and he wanted me to call back in 2 hours. Does this seem on the up and up? It smells a little fishy to me

shadokeeper
Ok I need some clarification. What exactly does the OC have to produce to prove that the account is mine. in addition can they tell me I need to contact the Collection Agency, and that the CA has to contact the OC to request the original contract. I have sent Letters to this OC requesting an investigation but have heard nothing from them. then I called them today See below. gawd i am so irritated! So confused lol. I am just trying to get things straight
Robert Nashville/Savannah
What are you trying to accomplish here?Is someone actively trying to collect from you for a bad debt?
shadokeeper
No the CA is not attempting to collect from me because they were unable to validate and had to be deleted from my CR's but the OC are still listed and I would like to see them removed, after all I do not believe I ever opened this account with HSBC, I have 2 current account with HSBC! and tis one i did not open...Why wont they just provide me with the information i requested? Rather than telling me that i need to contact the CA. They will not produce this information because it does not exist, and they are reporting on my CR's illegally. An i correct in my understanding of i am not please advise.(TU removed them back in January)
Robert Nashville/Savannah
Basically, anyone who reports data to a credit bureau has to be able to "back it up"...if that account was your account then they OC should be able to validate it but I'm sure they don't want to do so because that's work on their part for ZERO return for that work.If it really isn't your account then obviously they won't have any data to prove that it is.However, whether they cannot or will not verify the account to you yet continue to report the tradeline and "verify" to the bureaus than they've violated the FCRA - you can demand they remove the entry.Bearn in mind, if they will not remove the entry then you are only left with the option of going to court or dropping the matter. If this is truly not your account, do you believe it is just an error on the part of the OC or that someone has used your ID to open an account in your name? shadokeeper
How does this letter look for me to send to the OC? Requesting them to show proof that this is my account.. Dear Sir or Madam, I recently pulled my credit report for the first time. It says I had an account with you, but I have no knowledge of this account. I immediately disputed this information with Experian, and Equifax; the results of the investigation came back "verified". Since I have disputed this account with the credit bureaus and you "verified" it, I am very curious as to what kinds of "records" you may have for this alleged account. According to the new FACTA laws, you are required to conduct an investigation on this account, and I demanding said investigation at this time. Your company is reporting on my Credit Report and there for you are required to prove to me that this debt is in deed mine. In order to clear up this matter, I want to see, all documentation related to this account to prove I indeed am the owner of this account. If you don't respond with the results of the investigation (as is required per the Respectfully,Any advice or changes? Do i seem to have my facts in order?
