BeReady Posted April 6, 2008 Report Share Posted April 6, 2008 Found a CA on my reports for a medical collection. This originated from a med bill that should have been paid by med ins. I know the med service was done in 2/01. I never paid the $130 for this service since ins was supposed to cover it. Does the SOL start from the date of the med service or the date they sent it to the CA? I don't remember who the OC is so I can't call them to find out. Ahntara Posted April 7, 2008 Report Share Posted April 7, 2008 SOL is state law, so the answer will be specific to your location.In general, SOL begins with a 'cause of action'...something that was due didn't get paid on time and thus became delinquent. Medical service payments are typically due at the time of service and thus can be considered delinquent the following day. You can reasonably use the date of service for the beginning of SOL, but, once again, check your state's laws to confirm."...should list the OC..."Not on medicals. HIPAA prevents this.Since you're relatively sure of the service date on this, 2/01, I'd contact the CRA's are request DOFD. Reference the FCRA 1681s-2, Subsection 623 which requires Data Furnishers (even CA's) to provide CRA's the month/year that begins Reporting Period within 90 days of supplying the TL.
