2nd Lawsuit on Court Site

While looking up my current JDB case on the court's site, I discovered a 2nd lawsuit by yet another JDB, this time it's Midland. This was filed back in February, but I have not yet been served. I was able to download the complaint from the court's site, and this one doesn't even say it's credit card related -- Midland is claiming it is the OC and that I entered into a contract with them for services for a flat amount of $4k + change. Nothing is attached as evidence, so who knows what this is for--I've made no contracts with Midland, and since I screen all my phone calls, it's not possible I inadvertantly made some sort of verbal arrangements with them.

My question is, should I DV them even though I haven't been served? Given their historically sleazy past, I'm assuming they plan on proceeding with the lawsuit without ever serving me.

If it were me I would send the DV request. I would then also begin work on my answer to the lawsuit.

This gives you that much more time to make a good answer should they follow through. If they withdraw, then it's practice for next time.

Make sure your address is good and noticeable so they have no excuse for improper service. CMRR.

Thanks, they finally served it tonite, which is fine. There's no documentation attached, and they're asserting a contract exists for a fixed amount, which it doesn't ... so while I'll probably DV just for the heck of it, I'll just respond within the 30 days allowed.
