Your tax return is disposable income and all disposable income is supposed to be part of the bankruptcy estate and distributed to creditors. In the OP's case, you may want to inquire. Quite honestly, I am surprised to hear that any trustee wouldn't take all of it. But if that's what they do on a local level, then so be it. Maybe you'll be as lucky as mary. But when I filed bk in February and had to go to that class we were told up to 15K per year is exempt and that our trustee would rather we saved that money than give it to him to pay our creditors.I thought that was awesome.
