Unfortunately my tax return will not cover the debt owed. I would like to propose a new offer. I would like to offer $375.00 for settlement of the account; in return NCO Financial remove all collection information from all credit reporting agencies (Equifax, Experian and TransUnion) within five (5) business days upon clearance of received funds. Please consider that the Fair Credit Reporting Act does not demand that all accounts be reported, only that any account that is reported be reported accurately. Therefore, a company does have the legal discretion and permission to remove any account it chooses from the credit report. I am hoping that NCO Financial will do that in my case for this account.Your kind consideration in this matter is greatly appreciated.Best regards,REPLY:summed up basically they said no, stuck with the original offer to settle and said they will mark account as PAID.great....any ideas on my next step? Robert Nashville/Savannah Posted April 10, 2008 Report Share Posted April 10, 2008 Part of the art of negotiating is knowing when it's time to "walk away"...there is also a time to just say "that's not good enough" to the other side's latest offer then to shut up and let them make the next move.I don't know which is best in your case.If you think they've made their "best offer" and won't budge then it may be time to "walk away" for a while. If, on the other hand, you think they may yet budge but you just haven't hit their "magic number" yet then explain that their original offer isnt good enough (not necessairly those words you understnd) and rather than making a counter offer, just let them make the next move.Of course, part of this equation is knowing your "maximum" number...no matter how good an offer from them might be, it will never be good enough if you don't have the funds to respond.Good luck!Just an aside here...I'm starting to feel as if I should be getting paid a royalty fee from all of those using pictures of their dogs as their avitar...I think I was the first to do so and either I should be the only one allowed to continue or shoud at least get something in return for giving everyone else the idea!!! If the debt is legitimate on their end, then why do they need creditor info and your SSN? Sounds to me like they are attempting to shore up their records now that you've admitted the debt is yours so that if you attempt to dispute with the CRAs, they now have proof that A) You've admitted the debt belongs to you and You have supplied all information to tie yourself to it. I have been successful in getting NCO removed from every CRB...the reason is because they have no means to validate the debt upon request. MCM tried this crap with me and I told them to pound sand. I will not supply any CA with ANY information that implies that I acknowledge any account in their possession belongs to me. Because you did this in writing, you've now boxed yourself into a corner and made it virtually impossible to get this thing off your report via any other means than by and through their good graces. They're a CA. They don't have good graces. One of the hard lessons I think we all learn along the way. I would leave it alone and never contact them again. Robert Nashville/Savannah Posted April 10, 2008 Report Share Posted April 10, 2008 why do they ask for the ss number? if they are reporting it on the cra's..they have the number already!! anyway....I don't believe that's necessairly true...as I understand it, an information furnisher does not have to supply or have a person's SSN in order to report (frankly, the SSN was NEVER supposed to be used for identification purposes anyway but that's another discussion).As I understand, an information furnisher can supply a name and a couple of other pieces of info and that gets matched by the bureaus with "their" records as much as they can.That's one of the reasons why you should NEVER give your child your first name (and especially not also the same MI even if the actual name is different)...you can't believe how much of my Dad's info found it's way onto my reports over the years...it was a constant battle until my Dad passed away and there was no new informaion to report. I think it could become part of a one world government, but I guess that is a different discussion. I thought though the CRAs did use the ssn# to maintain our files... I don't have time at the moment to go back and look up everything but from what I've read and have benn tought in various classes over the years, when the social security act was being debated, Congress (and others) were specifically concerned that it woud turn into some sort of "national ID" number; concerned enough in fact that as a matter of law it is (or at least was) expressly forbidden to use a SSN to ID a person.Over the years, of course, that's pretty much exactly what the SSN has become.If I have more time later, I'll try and look up some decent sorces to see if my memory is in line with the facts! She sent me an email requesting additional information to locate my account04/07/08 ). I sent her the requested information(replied to her email on the same day I received the request) and on Thursday NCO was gone from two of my cr. I also received a letter on 04/12/08 from NCO advising me the referenced account(for directv) was closed in their office and they would notify the credit bureaus they work with to DELETE NCO entries.
