Where can I find the text to TFDCA?

The TFC 392 is a really good law. It makes the CA respond within 30 days of your DV letter. They can't just ignore you. All of the members of this board for the 49 other states should be writing their congressman to get something similar.

I may have to cite this law when I send a DV. Do you think I should resend a DV to the two CAs that did not respond? They are out of state CAs. I thought maybe I should try to get them on this violation, but in my DV I did not quote Texas Law.

If they are collecting debt in TX, they should know the law, you shouldn't have to cite it to them.

But even if they don't, it is not your job to educate them on the laws of how to do their job. I believe in simple worded disputes and dv letters. In my opinion, you want the person reading your letters to think you aren't working with the debt/credit repair company. Quoting laws is pointless...to me. Others think differently.

True, but when they didn't respond, I figured by quoting it, I am giving them reasons to respond.

If they did not respond in 30 days. File a well written complaint with an outline and timeline and file it with the BBB and the TX AG and the CA's AG.

Do you think I should do that in combination with the letter I am about send them or use it as the next step?

If you are 150% you have done as the TFC states and you crossed all your t's and dotted all your i's then yes. And that means, that you disputed the account with the CRA's via CMRRR, and got verified results and then DV'ed the CA via CMRRR. Then I would type up a well written complaint to the TX AG and CC the CA on it. Also I assume this debt has passed the four year SOL for TX? If not, proceed with caution.

Well since you say it is a small debt (and by that I mean you can afford to pay it if need be) then do not let that stop you, if the CA did in fact violate the TFC. Did you send your dispute via CMRRR to the CRA? Did they verify and then tell you to contact the CA? Did you mail them via CMRRR? And they not respond in 30 days? You mailed them at the correct address?

The only reason that I even know about this is because they showed up on my credit. They never even sent me an original letter to tell me that they were trying to collect. I haven't heard a peep from them. I have communicated with them, but I have heard absolutely nothing from them.
