Shae Posted April 10, 2008 Report Share Posted April 10, 2008 Just found out one of my charged off credit cards was sold to Jefferson Capital.I haven't received anything from them and they haven't reported yet. Do I contact them and try to settle this before they report? I was trying to get to the credit card company before they sold it but I didn't. You depending on that, you can try to call the OC back and request to speak to their senior most supervisor on duty and request they pull it back from the CA and you will pay it in full if they don't report it to the CRA's in a negative way, but get that in WRITING.But with that said, I've never paid a debt once it went into collections. With me it was an Aspire visa card, and they sent me a "Fresh start program" letter that said that if I agreed to pay $26 a month they would drop the original off my CRAs, and they would forgive a certain amount and transfer to rest to an Embrace card, which they did.I pay the balance below their required amount, they transfered the balance to another card, and they did issue me this card with no annual fee to rebuild my credit.I had just one problem with them. The bastards reported payments on a collection that they created on all three CRAs. I disputed it at first, and they refused to delete.Then I called up, and got the right person, and I told them that it did not say anywhere that they were going to report it as a collection. The notice only said that they would report late payments. I NEVER MADE A LATE PAYMENT.I was very angry, and I told them that I would not have paid a dime if I known that they were going to ding me with a PAID COLLECTION! I told the lady that its NOT a "FRESH START" program if you put this stupid collection on my record. I said I want it deleted NOW.She agreed to delete it and make an "exception". I don't know if they have been involved in lawsuits before or not, but she was willing to let it go.So if you get a letter like this, I would call them and tell them that you will do it on the agreement that they don't report it as a collection.She did not send me anything in writing, but she did do what she said she would, and I wrote down the date and time I spoke to her as well as her name.Hope this helps. According the the FDCPA if it is not originally reported and you DV it, they are not supposed to report it until after they have validated.However, getting them to follow this law is another thing, but if they report it before they validate it, then you could have them on a violation.
