rtre1979 Posted April 12, 2008 Report Share Posted April 12, 2008 Hello All,I lived in Texas when I opened my Providian account in 2001, then moved to Louisiana. the last payment being made in Sept 2003. Moved from there in June 2006 to Hawaii where I curently reside. Since the account went into default in Louisiana in 2003, the SOL there is 3 yrs and I could not find any tolling which moving would stop the SOL. Would this Louisiana SOL be valid since that's where I was living when the account went into default? Does LA have a toll statue on credit card debt? Or will they say Texas laws apply since that's where I was living when I signed the agreement and the Texas SOL and toll would apply?Just trying to figure this out. The SOL wehre you live now applies.With your example - the TX SOL applies as long as you stayed in texas. you did not, therefore Texas SOL irrelavent. Same with LA. you are not in LA, so LA SOL is also irrelavent. If you move to WA next week, you will be subject to WA's SOL, 6 years form the date you stopped paying on the account.if you move back to Texas or LA, you have "tolled" the SOL, which means the "clock stopped running" for the time you were out of the state.Does that help clarify things a bit?
