NewLife4Me Posted April 14, 2008 Report Posted April 14, 2008 To make a long story short..2002--Had a apartment while in college with roommate. i move out back to home state and roommate stayed in apartment. Roommate got evicted..2008-Ohio court tries to serve me Civil court papers in Tennessee certified mail but I was never home to sign for it and they sent it back after 10 tries.... Now the apartment complex lawyer have resent it to my mailbox by regular mail.My question is..What should I do with the envelope? I never opened it yetShould I send it back and write on envelope.."Return to Sender..No such person at address bla bla bla?"
looksbothways Posted April 14, 2008 Report Posted April 14, 2008 I believe in Ohio if you refuse the certified letter, they can send it regular mail and it constitutes proper service, so I'd open it at least.
NewLife4Me Posted April 14, 2008 Author Report Posted April 14, 2008 I am not in ohio. I am in Tennessee.
looksbothways Posted April 15, 2008 Report Posted April 15, 2008 I said Ohio because that's where the debt is from, so I didn't know what court they were suing you in, and also as a reference. Go here http://www.serve-now.com/resources/process-serving-laws/Tennessee/#404to read the rules for serving someone in Tennessee.
swirlgirl Posted April 15, 2008 Report Posted April 15, 2008 Two words: default judgment. You really want to be sure of the applicable service laws before you play this game.
