Guest e083697
HelloGroup moderators and members. I recently joined the groupAnd this is my first post. IM in trouble to make a long story Short. I had an account with National finance Company. I Got three payments behind. I made two payments the monthOf February 2008 with the hopes of getting it refinanced. When I talked with the office personnel they stated I couldNot refinance the account because the interest was too high.I had to make another payment. Before I could make a Payment the sheriff was knocking at my door in hopes of Giving a summons to appear before the magistrate. I was atWork and my wife could not get to the door in time becauseShe was not dress properly. That evening a male rep From National finance office came seeking a payment. He toldMe they could stop the court proceedings if I made a payment And paid the court cost. I could not make either at that time3/14/08. The rep went back to his car and sat for a while. ItWas close to 5:00PM and I had to run an errand. I think he Waited on the sheriff to return before I left for the errand.I got back in less than 1 Hour. The Sheriff left a summonsWith my wife. I go before the magistrate on 4/7/08. He Seemed to favor national finance. He told me to work out aPayment plan with National finance or in (10) days I would get A Judgement for the entire amount. Question: 1) Can I still send a validation letter? 2) National finance has pulled so many tricks That I feel I would be benefiting from a judgement. 3) I feel that I would have something concrete and Finally have some justice in repaying them.4) This account never charged off could they just take Me to Court? No collection agency at all just a Summons to go to court now facing a judgement. 5) I have 10 days from 4/7/08. Any advice appreciated.
montanatim
Question: 1) Can I still send a validation letter?Yes but it would be utterly useless at this point, and they would not have to answer it.2) National finance has pulled so many tricksThat I feel I would be benefiting from a judgement.Probably true.3) I feel that I would have something concrete andFinally have some justice in repaying them.If a payment plan can be brokered through the court, I'd bet the interest will be less on a judgment then on the original account. You'd have to do some research and the math to see. Their court costs have to be figured in too.4) This account never charged off could they just takeMe to Court? No collection agency at all just aSummons to go to court now facing a judgement.Yup. Doesn't mean it's nice or fair, as soon as you defaulted they had a cause of action to sue on. Unless your original contract says different.
