virginiabound
DH received a Collection Letter last night from AssetCare (ie: NCO) for a medical debt in West Virginia. DH hasn't lived in in the county where they say it happened in WV since 2001, and the last time he was at the hospital in Harrison Co. was way before then.Should I even bother DVing them, or should I just tell them to FOAD? flacorps
If it's a state owned hospital there may be no SOL ... and potentially even no FCRA sunset on the reporting of the debt. But that's a big IF. I'd suggest a DV.
virginiabound
They aren't reporting to any of the CRAs, this was just out of the blue. And it would have been United Hospital Center in Clarksburg, WV. From what I can see from their website, they are not a state hospital.
Robert Nashville/Savannah
Bottom line is, you need information...the best hope of getting that is the DV process. They may not reply or they may give you exactly what you need to know to decide on what the next step would be however at this point, I think a FOAD letter is premature and may get results you don't want.I would NOT start quoting federal law...simply be polite and ask for a complete explanation of exactly what this is all about - if they get tough with you then you can return the favor but don't start out with guns blazing.
