KennyC
I've been reading the main site and there is no concrete information.I sent my DV letters to all the Collection Agencies last week. These items I am disputing have been in collections for more than 1 year. Does the CA still have to respond?Sorry if this is a simple question, but I am unable to get concrete information regarding. Thanks in advance.
Robert Nashville/Savannah
Unless California law is different (and it may well be), collection agencies don't ever hae to respond to a request for validatoin and that's true whether the DV is timely or not...at most, all they are supposed to mark any disputed account as disputed on the consumer's credit history (assuming they report). You always have the right to dispute and request validation but usually a CA is not required to respond. So what should I do if they never respond? Do I just wait until the SOL is up? The main site states that the CAs have 30 days to validate and if they don't they have to remove it by law. However, the forums state what you just said.I am really confused because the main site and forums and different information or I may be missing something very important. So my question is, why would someone send a DV is the CA doesn't have to do anything about it. If it states in the TL that it is "in dispute" isn't it as bad as it was before? Thanks for any kind of reply. I've been reading these forums and the main site for a few days and I have a huge headache.

I've been reading these forums and the main site for a few days and I have a huge headache.I suspect you are talking about "credit repair" - there is a difference between dealing with collection action and simply trying to get something removed off your credit report. What I believe you are talking about is the theory of using the requirements of the FCRA and FDCPA in combination in an effort to "force" an information reported to remove a tradeline...you can find more information about that in the "Credit Repair > Credit Repair" section.
