sparky256DSL
verifies with Ex. I called today and spoke with a very nice lady at BofA. I have a PFD that I was sent from a MBNA (OC) agent for settlement. She didn't have a copy of the letter and I'm at work so I couldn't fax it to her. Anyhow the account is also incorrectly reporting the DOFD, so I asked her what the DOFD was and she said that since the account is over 5 years old she could not tell me the DOFD. I asked how they "verify" the DOFD for the CRAs and she said they just assume the reported infomation is correct and return the dispute. She siad this is their policy and that's what they follow. She was very nice and helpful but appologized tht she couldn't do anything for me. She said to call Ex (Special Handling Dept) and ask them to purge the account and they should because it is only 5 months from the time of removal.I figured I would call my SH agent when she gets back in tomorrow and see what she says. lovebug5
If it's that close to falling off of your reports, I'd definitely go the dispute route. Problem is, you don't have any of what this representative told you in writing...
sparky256DSL
I have STATEMENTS!!! Actually I just got some stuff from my Ex-Girlfriend and it contained alote of useful info (DOFD was Dec 00 - Jan 01). I sent this to Ex but they say they can't use it so I have to call back to the SH dept tomorrow when my worker is there and see what we can do about getting this fixed. I'm going to ask her to call and ask for the DOFD and see what they tell her Hope it works.By the way. Found out today I got a SH representative now
Robert Nashville/Savannah
I don't thik this is worth going to war over; at least not yet.I'd too would recomend the dispute route but frankly, if it's that close to being off your reports anyway, I'm not even sure it's worth the effort. If, however, this things sticks around and both the bureaus and BoA refuse to paly nice, then it might be time to bring out some big guns. TTigggers
I have to agree with Robert here. Why are you spending so much time on something that is going to fall off in a couple months?
sparky256DSL
Well the principle of the issues is they reported the wrong DOFD on all of my CRs. I have the statements showing the DOFD and all of the time up until charge off. I settled this account. I just feel like I paid for my mistake already why should I allow them an additional year on my report? I'm not planning on suing or anything, I just want to see how a CRA and verify information with an OC that doesn't have the proper paperwork. Obviously it probably wont go anywhere but hey why let them have it for free?
Robert Nashville/Savannah
I you don't like the advice offered you are perfectly free to ignore it.Understand, however, that copies of old credit reports are not proof - just because they are older doesn't mean than can be assumed to be more accurate than a credit report issued today. You need some actual proof of the DOFMD, hopefully form your own financial rcords or from the OC, if you really want to go to war over this. swirlgirl
Sparky, the CRAs are verifying because the OC is telling them to. Since the OC has told you that they don't have the proper records, you can send them a letter and request an account history and if they cannot provide that, ask them to delete from your CR. What you want is to have written proof that the OC doesn't have the records. When you get the letter, send a copy to the CRAs with a new dispute.OR, you can just dispute as obsolete and see what happens. Also, one of the biggest mistake people make in credit repair is to let anger and emotions guide their decisions. Sometimes fighting because of "the principle of the matter" is not worth the time and energy.
sparky256DSL
I have requested the account history and an investigation regarding the DOFD. BofA does not respond at all. I understand the CRAs are reporting what BofA is telling them but I have all of the statements that lead up to the charge off and it shows DOFD and then the increasingly higher minimum payment up to charge off. The problem is the DOFD was in Dec 00 or Jan 01 and they are reporting it as Aug 01. This is simply not true and I have all the statements and the charge off letter + settlement letters to prove it. The settlement on this account was after charge off and was made in Sept 01. TU and EQ accepted it and removed the account but Ex is not and has again "verified" it. I'm not trying to go to war or anything. I just want it to be reported correctly. On top of it all I have a PFD letter from MBNA that BofA will not uphold because "they have no record of that letter". I sent them copies and they still said they would not remove it. The lady I spoke to was very nice and she said that is theri policy and even though she thought it was worng she could do nothing about it. She spokje with a supervisor that told her I should have followed up with MBNA when I first got the letter and maybe it would have been removed. It also reports as OK up to Dec 01 and then says CO. Their records are completely out of whack. I'll probably speak with the lady at the special handling department of Ex and see what she says. I want to ask her to contact them and ask if they can truely verify the DOFD. I guess I'm screwed on the PFD unless I want to sue BofA, and I really don't want to go through that over a couple of months.
TTigggers
You said BOA did not respond to your Investigation.Did you send a FCRA 623 Investigation letter? If you did and they didn't respond they are in violation of the FCRA and you could use this to your advantage. sparky256DSL
Yeah I sent a FCRA 623 Investigation request 3 times and they did not respond at all. I would have to sue in order to actually "get" them on the violations, and that is probably not something I want to do.
