I have disputed 1 of my accounts and now TU sent me a letter wanting to see my discharge papers and list of creditors. Interestingly, I also disputed multiple accounts on DH TU and they have'nt asked for anything.

My opinion is that its not my responsibility to verify the info for them. Suggestions, ideas, comments?

They are a bunch of stinking hypocrites! I would not send them any of that. They told me the same thing. It is interesting that they don't have direct access to that.

I will tell you why I did not send that paperwork.

1. There might be an account or debt on the schedules that is not included on your file, and they may find a way to include it.

2. If you were to try to dispute it in the future, you won't be able to, because they have the paperwork

3. They my try to keep things on there longer by using the date on the schedules to their advantage.

Don't do it.

I had one account that showed a maxed out balance that I disputed, and they wanted the info. I said no. They still disputed it, and just blanked out the balance field.

Startingagain - I see you're in TN, same as me :D

You should tell TU to get stuffed.. more or less. A creditor does NOT have to be listed for a debt to be considered discharged in our district. If your case was a no-asset Ch 7, then ALL pre-petition debts are considered DISCHARGED, even if you forgot to list it.

The CRAs don't have direct access, per se, but they do have access to PACER IF they do a thorough investigation as they're supposed to - most don't.

If they have your bankruptcy on your reports, they have all the proof they need - you filed bankruptcy, it was discharged.

Sounds like there wanting 15 extra days to investigate your dispute. They have done this to me more than once. Don't send anything and don't talk to them on the phone until the 30 day dispute is finished.

Now that is a nice rule...

I think so too. This occurred when I called in a dispute, but it did not give them an extension, because I had just started the dispute with that phone call.

How do you know if your BK was a no asset chap 7? Is it listed in the paperwork somewhere? Does that rule about NOT being listed apply to all districts?

The Trustee files a 'no asset report' after your 341 meeting. That is the 'official' declaration of 'no asset'. If no assets are turned up during the process, it remains a no-asset case thru discharge.

See, my BK was originally a no asset but there was no paperwork stating that.
