beth206
Last Friday, I appeared for a judgement hearing and the case was dismissed b/c the plaintiff did not appear. Can they try and sue again? Do I still owe the debt? The county registry shows judgement filed for $0.
debtorshusband
If the case was dismissed "with prejudice", they can not sue again. If the case was dismissed "without prejudice", they can sue again. However, it's hard to say if they will or not. If their no-show in court was because they had no proof, and just gave up, they won't sue again. If they have the proof they need to win, and they didn't show up because of a clerical error, they might pursue and sue again.Nothing much you can do but wait and see.DH
