My account with Mervyns has been sold twice, but it is still showing up on the CR as and OC, neither of the CA's have bothered to log an entry. I phoned OC and was referred to the 1st CA, they then referred me to JDB. I have already DV'd JDB. 3 Questions: 1) Should I also send an investigation letter to OC as they are the only ones reporting on my CR? 2) Is this considered a timely DV as I have never received anything in the mail from JDB? 3) At what date does the SOL start. JDB says that it is from the most recent payment, but I have heard that it starts from the date of first delinquency? I believe that this account should have aged off in January, but JDB looks like they are re-aging the account to 04-03 to be a nuisance...

Many thanks for everyones assistance...

Account History:

GEMB/Mervyns sold to CA: Performance One (AKA Performance Capital Management) sold to JDB: Security Credit Services.

Sending an investigation letter to the OC requires you to have first disputed the accounts with the CRA's and the accounts having come back as verified. If you've done that already and the OC is reporting what you believe to be the incorrect DOFD on your reports, then I'd go ahead and send that type of letter out.

2) Is this considered a timely DV as I have never received anything in the mail from JDB?

It can always be argued that they did send you a dunning letter and you just didn't receive it...So I wouldn't bank on the timeliness of your DV.

3) At what date does the SOL start.

SOL is based off of the DOFD - you are correct...Unless you made any type of payment which would've reaged the account, that is.
