PCS Posted April 22, 2008 Report Posted April 22, 2008 Where do I find out the Statute of limitations on medical debt in the state of Missouri? I am not sure if it is considered written or possible open.
merrybucks Posted April 22, 2008 Report Posted April 22, 2008 I think most medical debt is considered as a written contract.
mandydm318 Posted April 23, 2008 Report Posted April 23, 2008 Look very closely at your state code because Arkansas has its own concerning medical debts and the SOL is only 2 years on those. While open contracts are 3 yrs and written are 5.
lovebug5 Posted April 23, 2008 Report Posted April 23, 2008 I think this is a pretty constant debate around here. But here's my two cents...When you go into a doctor's office or even a hospital, you typically sign paperwork agreeing to have the claim submitted to insurance...And that same paperwork states that if your insurance doesn't cover the bill, you're responsible. Therefore - you're talking written. So unless there are state laws in MO which redefine SOL for medical debts, SOL in MO for a written obligation is 10 years (per our little SOL chart on this site).
PCS Posted April 24, 2008 Author Report Posted April 24, 2008 Lovebug has the reasonable approach, but mandydm318 has probably seen the UDAP code which is why I am confused on this. I do not believe this debt to be written becuase of what I have read when I was not looking for it, now of course when I am I can not find it. I called the MO attorney general and the transfered me to the Dept. Of finance, the guy there told me that all debt has a 10 year SOL and if you owe a debt it stays on your credit report for 7 years after you pay it; and after nicely telling this guy he should not be telling people stuff if has no clue he said to contact an attorney. Thank god I live in Kansas!I will find this out and post it, thanks!
