Focus2069
Just to clarify,CRAs have to give you notice within 5 days of reinsertion of negative info on the credit report.but, do they have to give you that same notice if its the first time a new CA appears on the credit report, or new negative TL of any kind? Freak
No, I don't believe that is correct. They are only required to notify you on reinsertion of a negative TL when it has been removed.

swirlgirl
This question has been asked a lot. Do a search. I think your time and energy is best spent dealing with the debt and not searching for a supposed violation.
Fizzle1979
I think differently than SwirlGirl. I believe the consumer should educate themselves regarding the debt collection laws. It will put the consumer in a better position if it goes to court down the road.
swirlgirl
Fizzle, I completely agree. Consumers shoud be educated and learn the collection laws. I just know so many people try to find anything they can to stick it to the CAs.From my standpoint, I've had negative things posted to my CR. Nobody told me before the TLs were reported. But they didn't need to. I knew the instant that I didn't make the payment, the info would hit my credit report. What else should I have expected? A letter telling me they would report to the CRAs? Oh, I'm sure they mentioned it in one of the past due notices. Plus, it's usually in the fine print of most credit apps.
Focus2069
I wasnt trying to "stick it to the CA's" I have a debt on my credit report from a utility company that I never had service with. I just got the TL deleted from 2 of the 3 CRA's because they failed to answer the DV. I just have a feeling that it will be back, either by the same CA or having been sold to another CA.having a credit monitoring service doesnt qualify as notification, though, it has to be in writing, right? Fizzle1979
Yes once the CA' makes contact with you via phone, they must put it in writing within five days. However, if the CA doesn't have a valid address for you, they can't mail you anything, that's why SOMETIMES its good to answer the phone and tell them your address. But only in certain situations would I do this.

If it shows up again, you'll just have to fight it.

If any information that has been deleted from a consumer's file pursuant to subparagraph (A) is reinserted in the file, the consumer reporting agency shall notify the consumer of the reinsertion in writing not later than 5 business days after the reinsertion or, if authorized by the consumer for that purpose, by any other means available to the agency.
