They have provided a copy of application and bills (no affidavit from OC) for old cap 1 acct. I want to get rid of this and just pay. Not all of their fees since the summons was the first notification we received. No chance for Dving or anything just a summons. I don't want the stipulation that they sent either. I want a free and clear settlement no fees just the amount that was due. Please advise on how to write this out or a link to some samples. nascar Posted July 9, 2008 Report Share Posted July 9, 2008 At this point, you're asking for more than you're likely to get - considering the other side has already incurred the expense of filing suit. If you want to settle before this goes any further, call the opposing attorney and see if you can negotiate a settlement. If you work something out, ask him, "Do you want me to draft a settlement agreement or would you like to do it." Odds are, he'll offer to write it. In the meantime, you'd better focus on answering the complaint against you or you'll have other things to worry about besides trying to write a settlement agreement.
