vermonter Posted July 8, 2008 Report Share Posted July 8, 2008 Been dealing with an old debt...been to Mann Bracken, Palisades, Wolpoff Abramson( stating representing Palisades) and now to another attorney supposedly representing Palisades. They have called me several times, and sent the dunning letter. I sent validation and cease and desist CMRR, and have since gotten two collection calls since the date I have on return receipt, so I sent another validation letter, again,CMRR. I know they have violated but I am not interested in pursing that, only making them go away finally! They sent me back a copy of that letter with a handwritten note on it that they have requested copies ofmy statements and application and it could take a month. The same story I have heard from the 3 agencies listed above. Palisades has sent me copies of 3 statements from 2002, including the charge off statement., but that was sent long ago and they haven't done anything in the year! the DOLA on an old TU report is 2001. So I know that this is past SOL for my state ( vermont = 6 years) and I will fight it, if it comes to that...what I am wondering is, in your experience do you think they will attempt to sue? I have pointed out in my letters to them that the SOL is likely past. So I am sure they will be knowingly wasting the court's time. Link to comment Share on other sites More sharing options...

I really wonder if the attorney would be so blatant as to sue me if they knew it was SOL and I pointed that out to them...or will they just give up and send it off to someone else.
