What is my next step?Back on September 15, 2005, I received a letter from Palisades about an ATT account for $351.64. I sent a DV to Palisades on October 28, 2005 (TL was not on my credit report). In the meantime, while waiting on response, I received another collection letter on November 3, 2005 attempting to collect. On November 7, 2005, I received a letter from Palisades stating they received my request for validation and I should hear something within 90 days. Didn't receive anything else from them during 2006. Then on January 24, 2007, I received another letter from them again attempting to collect on the account. So I sent another letter to Palisades on Feburary 2, 2007 reminding them of the DV letter I sent on October 28, 2005. In my 2nd letter I stated this information and still requested another DV. By this time, I noticed that the TLs had been added to my TU and Experian reports. I didn't hear anything back from them so on March 14, 2007, I sent another letter requesting that it be removed because of their violations. I sent another letter on April 5, 2007 stating the same things. I informed them that I had reported them to the FTC, BBB, Texas Attorney General, New Jersey Attorney General and the Pennsylvania Attorney General. Again asking them to remove the TL. I received a letter from Pennsylvania AG office with letter from Palisades with old bills of the account. Now fast forward to today (July 17, 2008) and I have checked my CRs and the TL is on Equifax (CSC) and Experian.Now that you have all the background? What do I do now? How do I proceed. Any comments are welcomed.I think a consult with a good attorney is in order.Based on what you said, it seems you have multiple violations of the FDCPA and FCRA. If the attorney also thinks so, then perhaps an ITS letter is in order and if no response to that, a summons.Your other option is one final letter pointing out their violations and giving them one last chance to correct or you could get into the 623 process but I suspect that would be a wasted effort as if they had any intention of following the law they would already have done so. Robert Nashville/Savannah Posted July 17, 2008 Report Share Posted July 17, 2008 I mean no offense to anyone…this is just a general plea to everyone as I notice this problem more and more frequently it seems.Folks, please, please, please learn how to use the return [ENTER] key on your keyboard and create a paragraph or two…it makes your post ever so much easier to read.Crafting a post to an internet forum should take no less effort than crafting a great DV letter or letter to the editor and if you think about it for a moment, a post on a forum like this will likely get read by more people than you’ll ever reach any other way in your whole lifetime.With rare exception, all we know about a poster or his/her issue is what they say and how they say it – the sum of your posts is you online reputation (good, bad, accurate or inaccurate). It’s up to you to write posts that convey information in a well thought out and acceptable manner and doing so shows consideration for the people you are asking for help/wanting to read your post.We all make mistakes (typing, spelling, etc.) but that doesn’t mean we shouldn’t try to avoid them. One long never-ending paragraph with misspelled words, poor grammar and incorrect punctuation is a good way to keep others from reading your posts, let alone responding. I would file a complaint with ACA International too while you decide whether you should pursue it in court or not, depending on what your lawyer tells you.The most serious FDCPA violations I can see are too old to pursue.
