Divorce fallout - Any hope to remove foreclosure?

Hello all,

I have a client that needs to sell his home, and buy one in another school district due to the latest court decision in his child custody case. bad news for him is that his ex-wife was just foreclosed on in March. she was awarded the home, and the debt in the divorce decree, but she was never able to refinance the home into just her name, so now he has a foreclosure on his credit report. he's also being sued by the 2nd lienholder.

have any of you been successful in removing something like this thru a credit repair agency? i'm highly skeptical that anything would work. but we have much legal documentation to prove that she had been awarded the home, AND that the judge had ORDERED my client NOT to intervene for 3 months which resulted directly in the foreclosure.

WHAT?!? How could a divorce judge order something like that?

For general background info: Your clients divorce is between him and his ex. It doesn't impact or supercede other contractual obligations. The mortgage companies could care less that a divorce took place. The judicial orders and divorce decree will make NO difference to them or to his (or her) CR.

He is still liable for any debts incurred in the marriage regardless of what the decree says. Nevertheless, I'd still recommend that he fight both the legal action, mortgage companies and the Public Record of Foreclosure using the items you have. Try standard dispute procedures...they can be found in the stickies.
