how should i settle with AMEX?

I also have a situation with Amex. A woman named Kim Collins supposedly from the Law Offices of Mitchell N. Kay in New York, left a message at my work voice mail. I called 866-444-7830 today and she wasn't there, her "manager" Paul answered whom immediately started screaming and yelling all kinds of things harrasing the life out of me. Didn't let me talk at all and hung up the phone saying that "I'll see you in court, cause you'll be sued". As a professional for many years I know this is not the type of behavior from a law office, so I called back and asked to speak to the woman again and was transferred back to the same man. They are trying to get money from me from my past employer's credit card account that they never paid. The american express account belongs to the employer but I was a "cardholder" on the account along with three other individuals. This debt collectors are mixing up my personal american express that it's up to date with that "corporate" card. I'm going to put a complaint against these folks. Today I prepared a DV letter with the help of this site and will wait and see what happens.

Merci -- I is considered impolite to hijack someone else's thread -- it gets confusing when there are multiple conversations going on at once.

Crash -- there is no simple answer to your question. Amex is usually pretty aggressive with their delinquent accounts. My guess is that you have been dodging their efforts to contact you. Otherwise, there would have been a lot of contact over the past four years.

You worry about "wake the sleeping giant". First, I doubt they are as asleep as you think. Second, if you really want to settle the account, you are going to have to make contact and start talking. When you call you may discover that the account has already been assigned to a collection agency or a collection law firm (such as Merci refers to). You would be very naive to expect "nice".

Actually, it is entirely possible that you have been sued and don't even know it. A judgment could have already been awarded. If you have been out of contact, you just don't know.

As much as this will distress you, my advice is to contact Amex and find out exactly where you are and then deal with it as appropriate. Otherwise, hit the snooze button and go on with life.
