parsoc Posted August 26, 2008 Report Share Posted August 26, 2008 I thought I had included 2nd installment of 08/09 prop taxes in bk13 filing; the county said no, 2nd installment came due after filing. What bothered me more however was that she said interest and penalities keep on accuring through the 13! I don't think I was told that, or I missed it (amount is $2200); it irritates me too, that Honda is getting paid before these taxes are..they're both secured but somehow Honda has priorty? That is because property taxes are almost always paid the year following the actual tax year they are assessed for. So tax payments being made in 2008 are for the 2007 time period.And for the record, property taxes are assessed kind of like a lawsuit. The assessor has to file all the paperwork by a deadline and get it all approved by a special court. Then the bills go out after it has all been approved. Chances are that all this happened months before you filed. Therefore the debt was incurred before you filed. The payment due date is not relavent. If the court was to follow her way of thinking then anyone you owed money to could avoid the bankruptcy just by billing you for it post-filing, even if they held it for years prior.As for interest and penalties accruing...Not without the court's approval. parsoc Posted August 27, 2008 Author Report Share Posted August 27, 2008 Attny's office called and I spoke to the BK asst; said she'd check with the attny re specifics, but agreed with the county that the $544 wasn't "included".
