A little background(FYI)

1. My father and I share the same name and at least 1 address on CRA

2. CA can't seem to find me because I don't have land line or electric in my name and haven't for 3.5 yrs

I called a CA back after they bothered my parents too many times and asked why they are wasting their time on an out of statute-7.5 y/o debt.

They lady at the CA said she could send me a 1099-C since I stated that I did not plan on paying this debt.

Q--1-who sends the 1099-C and what amount should be on it?

2-can I get them for constantly bothering mom and dad since they can'y find me?

3-how long can a CA report a debt that is out of statute, but only 4.5 yrs old not 7?

4-is it legal for CA to make hard inquiry every week for 5 straight weeks on the same debt?

a newbie just trying to establish credit again after 7.5 yrs

FYI- I have changed addresses 7 times in last 8 yrs between TX(where debts occurred and went into collection) and FL.

You have some serious ethical issues in your life ... but so do your foes.

1. 1099-C should be for the total amount owed, although interest should be broken out if the interest would be deductible if paid (mortgage interest).

2. Mom and dad can get them, if mom and dad have sent them a C&D.

3. 7.5 years.

4. It's called "poisoning" your report, and there's a question whether it's legal to do an inquiry more often than is needed to verify the information that would be needed for collection purposes. I don't know of any successful lawsuits over poisoning alone, however.

Trying to establish credit again is what brings 'em out of the woodwork. If you're insolvent though, the 1099-C is not so much of a worry ... check a form 982 to see if it would help you.

I don't see how you draw that conclusion from the OP's post. Seems to me that those are fairly standard newbie questions.

Newbie

1) made clear he was playing games with respect to his whereabouts (not living "openly and notoriously" to quote the legal language);

2) made clear he wanted to "get" the creditor; and

3) most importantly, he chose a screen name that clearly indicated his frame of mind.

So that's how I draw that conclusion. I'm seldom so judgmental, but Robert_Nashville's "Holy Sheep" triggered my dodgy debtor detection system--a rarity, per my prior posts on the subject of morals and ethics in credit repair.
