bidasx
Ok I got a dismissal with prejudice since the JDB's attorney didn't show up about 4 weeks ago. It never got sent out by the court or updated on the case log though; so I talked with the court clerk yesterday and they said they would have the judge sign a court order and send out the papers to all parties stating the case has been dismissed with prejudice. Now the only thing that can happen is the other attorney files a motion to reconsider. My questions are... How long do they have to file this?If there is a time limit, would it start from the court date, or from the day the judge signed it and sent it out? calawyer
The statute you should look at is CCP section 1008.http://www.leginfo.ca.gov/cgi-bin/displaycode?section=ccp&group=01001-02000&file=1003-1008The time runs from service. If service is by mail, add 5 days.
