I did not give any info, even though they tried and got real pissed at me. Turns out it is CCA Isnt this misrepresentation? How do I record this on a razor cell phone? I don't understand how they could be making the calls you describe. I've recently seen some court documents wherein they swear that they don't use autodialers or leave recorded messages on cellular telephones. I just don't get it. Gearing vs check brokerage holds that misrepresentations are actionable regardless of intent. 233 F.3d at 473. The "FDCPA is a strict liability statute," and "proof of one violation is sufficient to support summary judgment for the plaintiff." Cacacev. Lucas, 775 F. Supp. 502, 505 (D. Conn. 1990).
