I noticed this right away and contacted my attorney who forwarded letter to credit reporting agency and CA, it was removed the next day.Is it legal for them (CA or agency) to request/issue the credit report after the SOL has expired (expired by 18 months)?I read it is a voilation of FCRA Section 604 (A) (3) and carries a $1,000 violation fee.I appreciate the input and verification.Thanks Link to comment Share on other sites More sharing options...
Robert Nashville/Savannah Posted September 8, 2008 Report Share Posted September 8, 2008 If the original creditor had permission to pull your CR then subsequent creditors and/or any CA attempting to collect for the creditor also has the right to pull your CR; whether the SOL has expired or not is immaterial.If there was no permissible purpose to start with then most would argue that no permissible purpose ever exists but I've hear arguments on both sides of that issue.By the way, there is no need to post the same question twice, especially in the same forum.
