Lisam9072 Posted September 16, 2008 Report Share Posted September 16, 2008 I have Portfolio reporting on 2 accounts, that are first off past the SOL. They still validated with all 3 CRA's. I sent two seperate letters certified demanding validation. One letter came back that since I claimed my identity was stolen (which I am clueless as to where they got that, I have never even said anything to that regard)- they need to see a police report. I never recieved a response from the second letter. In the meantime they call daily, I sent another letter for each account along with a letter to cease calling me and the only correspondance I will accept is written. They did sign for it 2 weeks ago and I have still recieved phone calls and now they are calling my cell. Do I even try and take them to court ? Or do I just send everything to the 3 CRA's to get them to remove it from my credit report? Or file a complaint with the Illinois AG? I am still all new to this, I have many items on my credit report that are all past the SOL. So I am still new to all of this. I love this site.. flacorps Posted September 17, 2008 Report Share Posted September 17, 2008 Portfolio and their attornies will file suit past the SOL in states where the courts won't spank 'em for doing it. They will get default judgments that are just as good as judgments on cases that weren't SOL when they were filed. Don't assume that Portfolio won't sue you tomorrow. Do engage with Portfolio, and make clear to them number one without validating they have not shown any grounds for issuing a 1099-c and so that better not be happening and also that suing past the SOL is an FDCPA violation and that you will pursue them for it if they do it and that since you are notifying them now they will not have a bona fide error defense.
