dkorte
I posted this on another forum, but no one seems to have any concrete answers for me and I'm unsure as to what steps to take next. I'm hoping you all may have some suggestions....Hello all,I'm writing to ask for some advice on what to do next. I thought I went about the PFD process the "correct" way, but obviously something went wrong, as the CA has not deleted, but instead updated the tradeline to show PAID. I really needed this deletion and I'm so mad that I am getting sick to my stomach. Here's the skinny....Hang in there...it's long.On August 20th, I sent them this letter CMRRR. They received it a couple of days later:MeMy StreetSomewhere, USA 12345Via USPS certified mail #0000 0000 0000 0000 0000August 20, 2008Dear Security Check, LLC,This letter is being sent to you in response to multiple listings on both my Experian and Equifax credit reports. I recently found that you have listed these debts:Account #: XXXXXXXAccount #: XXXXXXXAccount #: XXXXXXXAccount #: XXXXXXXI dispute your claims in their entirety and I am requesting validation pursuant to the FDCPA. Please be advised that it is inconvenient for me to accept phone calls so any communication on this matter should be made through the US mail.Sincerely,Me_____________________This was their response (the same letter for all 4 accounts):August 25, 2008thatgirldinare: Account # XXXXXXXCheck #1234 dates 6/18/08 payable to XXXX XXXXX in the amount of $16.23 and a service fee of $35.00.I have included a check for you. Please remit balance of $51.23 toSecurity CheckPO Box 1211Oxford, MS 38655Please notify me when payment in full has been made and I will submit this account to be deleted from your credit.Sincerely,Amanda StoneDisputes Dept.___________________________________So, I sent them this letter along with the money orders to pay in full:MeMy StreetSomewhere, USA 12345Security Check, LLCAttn: Amanda Stone/Disputes DepartmentP.O. Box 12112612 Jackson Avenue WOxford, MS 38655September 18, 2008Good day Ms. Stone,I am in receipt of your letters dated August 25, 2008 and appreciate your quick response to my concerns. As per your request, I’ve enclosed copies of our prior correspondence, as well as separate money orders for each account listed. By cashing the enclosed money orders, Security Check, LLC agrees that these accounts will now be considered paid in full, and as promised, you will be deleting the tradelines in their entirety from my credit reports. I sincerely thank you for your willingness to delete these negative tradelines, as well as your prompt attention to this matter.Warm Regards,Me_________________________So what did I do wrong? Why did they not delete, and what do I do now in order to get them to remove the negatives completely. I'm struggling with the idea of calling them and giving them a piece of my mind, but I remembered to stay off the phone and decided to come here for advice first. Any help would be greatly appreciated.
new mom
Just my .02...dispute with the CRA and send them a copy of the letter from Security Check showing that they will delete when PIF. I did this regarding an acct that I had and it was deleted from all three of my CR's.
lovebug5
Although the CRA's are required to use a consumer's submitted documentation during investigations, they rarely ever do so on the first try. I'd file complaints with the BBB and AG regarding this situation, then send a strongly worded ITS letter right back to the CA with copies of all prior correspondence AND your BBB/AG complaints. I suggest this because it worked for me quite a few times.
isislc
How long ago did you try to dispute with the CRAs? If you were expecting the accounts to disappear from your CRs by just waiting for it to happen, usually it doesn't happen that way. If you haven't tried to dispute the accounts yet, I would recommend doing it like Newmom and Lovebug recommended. At this point, I don't think sending them any documentation is necessary. When you dispute, make sure you say that "creditor agreed to removal of account" or "paid before chargeoff". It should come off easily by then and you can also include the phone number as well as Amanda Stone's name in the comments box for contact info if you dispute online. unusualsuspect
Well if they don't honor their agreement, sue them! It's a written contract...Don't even give them a chance.
