d_nihil Posted October 3, 2008 Report Share Posted October 3, 2008 A collections law firm calling itself Meridian Management Solutions / Brachfeld and Associates has been harassing me over the phone regarding a debt that I purportedly owe to Capital One. When I finally got the money together to pay them the amount that I did not dispute, they refused a bank check or money order and demanded that I give them access to my bank account to deduct the money directly. Now, my mama didn't raise no dummy... and I know the kind of damage that an unscrupulous person can do with your bank account info and the last four digits of your social security number... so, being that I have no love or trust for bottom-feeding scumbags, I politely refused. Since then, they have been blatantly harassing me, flagrantly violating the California Fair Debt Collections Act, leaving threatening and insulting messages on my cell phone despite being told not to call me, and even attempting to con my personal information out of me when I do pick up their calls.I have retained an attorney to represent me in this matter. He is interested in finding other people who have suffered similar treatment at the hands of these parasites, in order to launch a class-action lawsuit against the firm. LUEser Posted October 3, 2008 Report Share Posted October 3, 2008 How about recording the call to them that you'd like to pay, and see if they again refuse to accept it. That'll look real good in front of a judge. "Your honor, I was trying to pay them by money order, which is secured funds by the way, and they wouldn't take it, they kept insisting on my personal bank account information." So far I've only been able to plug my phone into my laptop to record the voicemails that they've left me. I haven't been able to run it through the computer (or some other device) to record an actual conversation with them. Getting something like that on tape might be worth actually spending a little bit of money on, to pick up one of those phone recorders. Maybe my lawyer already has one. I'll check into that. Thanks! d_nihil Posted October 3, 2008 Author Report Share Posted October 3, 2008 My laptop's bluetooth enabled, but my phone is a dinosaur (shows where my priorities are, I guess).
