DV response

Recommended Posts

Nope, however given the lax standards of validation under the FDCPA it could be construed as "validation" if you don't reply and object. Send another letter back with a copy of their "affidavit" and state that this is not validation, say it would be considered self-serving 3rd party heresay in a court of law. In your next sentence state that anything on their letterhead or of the JDB they represent would also never be considered validation.

Tell them to obtain and forward from the alleged original creditor with whom the "supposed" debt originated a full accounting of this alledged debt.

Always use the word alleged and never admit anything, actually this verbage is what I'd include in my first DV to collectors. This almost always negates this type of response.
