Question about answering machines & collection agencies

If you do not wish to speak to a Collection Agency, you are under no obligation to answer the phone when they call. If you have an answering machine, and they leave a message, you are under no obligation to return their call.

Regarding whether or not to have the answering machine turned on, I would go with having it on. They may not leave a message, but sometimes they may leave a message which violates the law. It can be handy to save that message for future use. Also, you can pick up or call back for people you want to talk to.

If they are unable to reach you by phone, they will eventually send a letter. You must respond to this letter appropriately. If you don't know how, search this site or ask.

Don't let fear of collection agencies run your life.

Good luck.

thanks so much, I didn't know if they left messages for you to return their calls, if that would give them reason to use something against you by saying that they left message on such and such dates etc?

thanks so much for your answer,

they can make you so sick and due to unfortunate and unexpected life happenings we are in such a bind it is bad enough knowing you can't do much about things but when they call you just cringe,

this looked like an awesome site for some support

thanks

I guess if they say you need to call them such and such day or just as some type of reference that

they could say I left message on answering machine and they did not call back or something like that.

nope, they cant do that, as if you dont answer, they cannot confirm that you are the one that answers the phone.

if your that worried, just pickup/hangup on them, you dont HAVE to talk to them.

Hell, I let my 2 and 4 yr olds answer the phone when it is "out of area" or "private caller"

No, no, no.

That's just them trying to get you stressed out (which seems to be working - don't let it!) or get you to call them back (don't! Unless you're confident you can handle them, they'll eat you up. They have more experience at these discussions than you probably do).

They say all kinds of things. Standard, underhanded tactics, but probably not illegal. Do any of these things sound familiar?

"I must hear from you by 5:00 pm today to prevent this from going any further."

"After Aug. 30 I won't be able to work with you."

"If I don't hear from you I will have to make a decision on your behalf."

"This is concerning an issue in your county courthouse."

"This is call is being entered into your file as another logged attempt to reach you."

"Failure to return this call will be marked in your file as a refusal to pay."

"If you fail to respond this matter will be transferred to legal."

Get the idea? It all means nothing.

Regards,

DH
