I just heard from someone in the military that NCO sent their Commanding Officer a "letter of debt", which will now cause this person to possibly be denied promotion unless debt is paid. They were also told that the S & S Relief Act does not apply to them because the debt was not sent to collections prior to enlistment.

I have never heard of this and can find no reference to support NCO's claim. Is anyone aware of anything that would fit this scenario.

They are wrong for doing what they did. I had the same thing happen to me when I was in. At that time I was stationed over seas so I contacted JAG and enacted the S&S act to keep them off my but. My command was PO'ed about it, but I explained things to them and they worked with me. I was never in any trouble with them before that happened to me so my command was cool with me. It looks like to me NCO knows that the military frowns heavily on personell having debt problems. This is no different of harassment than if NCO sent a letter to your Boss/or work. The S&S act does apply, that moron at NCO is not going to tell him/her the truth because they know if they enact it they won't get a dime. Great God, please tell me he is going to sue the begeezus outta of them?

NCO has already lost this lawsuit by doing this. Tell your friend to make this as public as possible. Can't even imagine all the laws broken Federal and State.

Thanks all for your responses. Sorry for being slow, was busy the last few.

Update: this soldier has an appointment with someone on base. He is not aware of what it is for yet. It isn't JAG.

I will share your comments and take proper action. Will update accordingly.
