red1gtrubodsm
Does a CA or JDB have the right to pull my CR if the debt no longer is valid? I have written proof from a JDB that 2 accounts were closed and never to be reported again. Yet I pull my CR today to find out that infact they have "soft" pulled my CR 5 times sinse I had the accounts closed. I have written documents from their corporate attorney stating they are ceasing all collection efforts. Im just confused a bit. I know it is just a soft pull, but why? Need a little more information on the debt itself. If you never paid the debt and it is still within SOL, then yes they do have permissable purpose to pull your credit report. Also, if it is out of SOL, you live in a state where any CA can try to collect on it even though it is too old to do so. Would still need a little more information to get more specific on this case though.

My state requires a license to collect and I contacted my state AG. They responded to my AG with a fax that state they would completely cease all collection activity, and agree to never sell or assign this debt to another entity. This came directly from their corporate attorney. There are 2 accounts that were with them. 1 in SOL, 1 way out of SOLNeither debt was actually paid. I had so much legal ground on them that they agreed to never collect again
sgip2000
This is a good question. I too have "soft pulls" from Arrow on an account that was discharged in CH7 4 years ago. They continue the "soft pulls" every 3 months.
isislc
This is a good question. I too have "soft pulls" from Arrow on an account that was discharged in CH7 4 years ago. They continue the "soft pulls" every 3 months.Well for sgip, you should send Arrow a nice little Cease and Desist letter telling them that they have violated your BK stay and if they do not stop pulling your CR you will follow through with legal remedies in Federal Court which also includes damages for their actions. Now for Red, take a copy of that paperwork and send it to the CA and demand that they cease and desist all attempts to contact you. If you see another pull on your CR that you will follow through with legal remedies since pulling your CR with no permissable purpose is a violation. You both have good cases here but sgip, you need to get on top of this right away since it is violating the conditions of your BK discharge.
