wolfhound
Is it true that a collector (in this case the vile W&A) has one year to attempt to confirm(get a judgement?) an arbitration award from NAF?Last year on July 28th I got a letter from the collector informing me that NAF had issued an award against me. My attorney responded with a nastygram. The entire process seemed like a railroad, we had heard nothing from them after my attorney responded and requested an in person meeting.Anyway, the award was apparently granted last summer, and it's now almost Halloween and nothing seems to have happened. My attorney did demand that they notify us if they intended to go to court. So, would I seem safe now?
Recovering Attorney
they have 1 year to confirm the award, by suing you in court.
wolfhound
Well, it's been 1 year and 3 months, so it seems I'm clear of this one.Why would they go the the trouble of doing this and then stop?
borgman72000
I'd check with your local courts and make sure you're not a victim of sewer service.
NYMatt
Maybe they already had the award confirmed.
wolfhound
Don't they have to notifiy me and/or my attorney that it's going to court?
NYMatt
Don't they have to notifiy me and/or my attorney that it's going to court? They probably do but that doesn't mean they will.Or maybe they'll make it appear they did .
wolfhound
Well, they obviously had my address, as well as my attorney's, so I don't see what kind of excuse they could use....
Florida_Bronco
My guess is that when they realized you had a lawyer, they knew they would have a fight on their hands so they decided to spend their time elsewhere. Taking that into consideration, I would doubt that you were a victim of sewer service. Doing sewer service in that situation would be just asking for trouble.
