RJM Acquisitions just agreed to our PFD, but I still have a question for those of you who've had PFD's agreed to. The letter they sent us seems like a form letter which agrees to delete the files once the bill is paid. It's not signed by one of their reps though. Would this letter still be good enough for a CRA once it's paid, even though it's not signed by a rep? Note: I have also requested them to send us a letter within 5 days of receiving pmt stating that the acct is PIF and they are gonna delete. There usually is by like an accounts manager or someone that you can follow up with a phone call if they don't follow through with their promise. It just states, "Based upon a review of this account, RJM is pleased to accept the sum of XXX in full satisfaction of the above referenced account. Please pay by Nov xx. Upon receipt and clearance of $XXX, this account will be satisfied in full, and, as per your specific request, RJM will request our reporting of this account be deleted from your credit report."They then go on to state their methods of pmt accepted... mo, check, etc.This is an attempt to collect a debt. Any information obtained will be used for that purpose; and, This communication is from a debt collector.They also included a payment coupon to send it with check boxes for x-Enclosed is my pmt of XXX. My account is now satisfied in fullx-Please delete RJM's reporting of this account from my credit reportx- Other: (to which I wrote) Send me a letter in 5 business days stating you have received pmt in full and are going to delete from credit reporting agencies.PLUS, I added a letter stating the above.Although I have read that RJM does do PFD's, I'm kinda skeptical since this is our first PFD and they don't have the information, such as a signature from an authorized rep, which I'm told I will need in order for a CRA to delete if RJM doesn't abide by the agreement. It has to come from the furnisher. They have no reason to believe you didn't forge the letter yourself, and looking at it that way, you really can't blame them for not deleting. That being said, think about this;You have to be willing to sue them but consider adding some token amount to your agreed upon payment. If you promised to pay $100.00, send them $110.00. In addition to that, rewrite the agreement to include a statement like the one below. Sign it, send it and see what happens. "In return for $10.00 consideration paid, as included with payment for agreed upon settlement balance, RJM agrees that all references to said account will be removed from my credit reports within 30 days of receipt of payment and that no references to said account will be reinserted at a later date, and that the "account" or any information pertaining to it will not be sold, assigned or otherwise transferred to any other entity who may, upon its own initiative, cause this account, or any derivitive of it, to be reported any credit reporting agency. RJM further agrees that should it violate or otherwise not comply with the terms of this agreement that RJM shall be liable to [insert your name] for liquidated damages in the amount of $1000.00 as well as all costs and fees associated with the enforcement of the terms of this agreement. I sent my own PFD letter and the Accounts Manager signed it and returned it to me in its original form. The listing was gone within the week. NP, I can't answer that one. I'm not experienced with that. Is it for a CC or something else? If we know what it's for, the others would be in a better position to help you.
