Amanda
I have been following the validation steps with a Collection Agency. I found out about them when I pulled my credit report. I am writing the 2nd DV and using the FDCPA. My question is that they havent tried to collect, what they have been doing is to report the collection to the Credit Report Agencies and verify the debts with the Credit Agencies when I dispute the Credit Agencies. Can I use the FDCPA even though they are not doing anything to collect? Its strange because they verify the debt with the Credit Agency but do not send me a bill or anything. Are they buying time to sue me?
willingtocope
You'd have to do a search to find the exact case law, but I'm pretty sure there have been some references on the board here that says that reporting to the CRAs is considered collection activity.
