cchelps Posted November 10, 2008 Report Share Posted November 10, 2008 I'm being sued by Discover Card Attorney is Mann Bracken I wish i found this forum along time ago. Im located in Los Angeles CA I have a mail box etc. box and i never received the service of process in person it was in my mailboxetc box. I filed an answer within the time frame which now looking back was not a good answer my answer was "I deny this is my debt and if it is my debt, I deny that it is still a vaild debt and if it is a valid debt, I deny the amount sued for is the correct amount." I have yet to receive anything from the court answer received and filed on 10-6-08. Wondering if i should send a request for production of documents to Mann Bracken or wait for courts decision. admin Posted November 10, 2008 Report Share Posted November 10, 2008 I would see if your court rules of procedure would allow you to file an amendment to your answer. Also, see if you are within the time frame allowed to file a motion for production of documents. But in any case, you most likely will be fine. cchelps Posted November 10, 2008 Author Report Share Posted November 10, 2008 I dont believe its arbitration cause filed limited civil and i do not see any arbitration anywhere on the summons i looked it up locally seems to be in front of a Judge. debtorshusband Posted November 11, 2008 Report Share Posted November 11, 2008 In California the legal process is a lengthy one.First, a Case Management Conference will be scheduled. I think they try to hold these within 135 days of when the lawsuit was filed. Note that both parties need to file a Case Management Statement prior to the Conference.
