carol Posted November 11, 2008 Report Share Posted November 11, 2008 Hi everyone... My life has been ok... I am back...My sister, (Florida) has a checking account with her boyfriend on. He had a cable bill of 500.00 $. They went into the checking and took the money.It was his bill from other resident. She called cable and bank and said to put it back, but did not. He did pay a payment at one time with checking. No notice they were doing this. Bank was rude to my sister as well. Her friend called as well and said that was not his money. And before August I would have said you are definitely right...However, last Aug I terminated my service with Directv. Paid the remaining service charge for Aug and sent back my receiver. I also talked to a CSR because although I had Directv for yrs, it was considered a cancellation of contract and was told by CSR that they would go back to every form of payment I had used over the years to collect the fees due for the rest of the contract period. They would just take the funds. According to them, once you send a check for payment on a given month, they can keep accessing the account to pull new funds, without my permission. Natually I went over the CSR's head to a supervisor to get the matter closed...but it was a long, frustrating and tedious process to get to someone to change that process.So the OP might have to go through channels to get her money back Link to comment Share on other sites More sharing options...
Methuss Posted November 11, 2008 Report Share Posted November 11, 2008 Under the Wire Transfer Act it is illegal to pull funds from a bank account wihtout hte account holder's permission. Just because someone paid with a check does not give this permission under any law. The bank was uncooperative because under the WTA the bank has to put the money back and then try to recover the money themselves. If they are unsuccessful in recovery, they have to absorb the cost. BTO429 Posted November 13, 2008 Report Share Posted November 13, 2008 Totally illegal to take money out of an account without the account holders permission.It is the banks responsibility to make sure the person that tries to take money from an account that is not theirs has permissible purpose.
