Is this legal? Can these CA's only accept payments over the phone? This guy also threatened me that if I did not come up with the money in 48 hours they were going to pursue legal action. I was planning on sending out the DV letter today but now I'm worried that the DV letter won't get there in time. Are they just using scare tactics, or are they trying to sue me before they recieve the DV letter? (I let them know that I was sending a DV letter because two other companies are trying to collect on the same debt - Should I not have informed them of this?) txlimo Posted November 11, 2008 Report Share Posted November 11, 2008 Sounds like he is just trying to pressure you to get the money as soon as possible especially if you have 2 other CA's calling you about the same debt. StressPot Posted November 11, 2008 Report Share Posted November 11, 2008 I agree.I am not sure about the legality, but it's a common fact that CA's do and will lie in order to get paid.Most if not all Collection Agents get bonuses at the end of the month as a percentage of what they pull in for the month, that is their motivation for lying to you about the urgency and method (phone only) of payment.You should still send your DV to them, in the mail CMRR so that you get a little green card back. File this card for your records. Personally I would handle all contact through the mail, and let them talk to voice mail/answering machine.On a side note, talking to a CA on the phone is at your own risk. You are not required to give them any information, and rest assured that any information they do get out of you will be used against you.Note: NEVER ever give out your banking or payment information over the phone to a CA.Good luck with your situation and keep reading here!
