Cap One question...

I am new to this. Cap One says I owe them. They transferred the file to their collection department. I started the DV and have finally recieved a response from letter 2. They claim I applied online or by phone and do not have a signed application. They sent a copy of 3 bills they supposedly sent me, which I did not get. I have done the disputing with the CRAs and Trans and Eq have taken it off. Exp will not but will not provide me with method of validation, or anything else. Have they successfully validated in sending me the bills? I don't even remember signing up for this card. It is set to be taken off of my report July 2009. If I wait it out, would they sue (if you've had experience with Cap One)? Should I continue on with the 3rd letter and proceed with a suit? I live in Texas. I guess, should I talk to a lawyer? New to this. Need help.

If you really don't know about this card , you may be a victim of identity theft. I would get all 3 reports and carefully go over them. Also, consider yourself lucky you got CRAP1 removed from 2 credit reporting agencies- they are known to keep perfect records and are difficult to get remove. afrom what I hear they love lawsuits- how much is owed? you may want to ride this one out- and then disput it as obsolete- after 2009 gets here

Just a reminder- check Texas law about SOL- someone here will know- just because the SOL is up- doesn't mean they can't sue- some scumbags will, and try to sneak a judgement- the SOL is a defense that has to be raised, by you ( if it gets that far) my guess is that this will die a natural death and you will see it fall off Aug 2009- if your patient
