The licensing requirements include the submission of an application, payment of a filing fee and investigation fee in an amount as determined by the Office of Commissioner of Bank of the State of Wisconsin shall assess, and the posting of a bond in a minimum amount of $15,000.00. I take that to mean that everyone who intends to operate as a collection agency, must obtain a license, as per the requirements set forth in that state. Some further research would clarify that. Some further research would clarify that.I always like to make that comment because it varies by state and can be a gray area. In my state, debt collectors do not have to be licensed. However, my city requires a license in order to collect a debt. The language is very specific and clear.In the Wisconsin language it says "No person shall operate as a collection agency or as a collector or solicitor in the State of Wisconsin with first having obtained a license." The CA could argue that they are not operating in Wisconsin. They are operating from another state. The debtor just happens to live in Wisconsin.This comes up quite often and I've not seen any definitive information on licensing requirement for non-resident CAs. CAs don't have to be licensed in my state either (taking that from another post, of course). However, the state of PA does adopt the same statues at the FCRA and about CA practices, I believe. I'll have to look that up, but I may have already posted a thread about that.
