When can you sue a CA collecting without a license?

Recommended Posts

If you have a collection agency without a license:

1. they have no license

2. they have reported and verified info on your CRA reports

3. have sent a collection/verification letter or...

4. they have not sent any collection letters

Can you sue them for no license even if they have not sent collection letters but the above is true?

Hello I agree 100% with willingtocope. In another thread I left some links for you to look through.

This link will also give you some insight. It is here at CIC.

So Who Can You Sue and What Can You Sue For?

Oh and here

http://www.creditinfocenter.com/rebuild/debt_validation.shtml

go to number 7 and click on "little cheat sheet" it says they are supposed to be licensed!

If you believe that they are not licensed, and licensing is required in your state, write them another letter and tell them they are in violation of your state's collection laws and are subject to prosecution and fines. Cite your state's fines and procedures in the letter. This is a last ditch effort, but has worked in some cases.

Definitely file a complaint with state AG. Worked for me 2 times now

That's because WA requires them to be licensed. OP's state (NM?) May not. OP needs to see what the State requires, then go from there.
